TERMS AND CONDITIONS FOR USERS PURCHASING PHOTOGRAPHS BY DOWNLOADING THEM FROM THE HOME PAGE

In these terms and conditions the above-mentioned business organization shall be referred to as Consignee. 
In accordance with the Contract of Use entered into by and between Consignee and the entities having exclusive copyright over the photographs displayed on the home page, Consignee shall be entitled to resale the photographs in the current format.
In these terms and conditions User is an entity that downloads photographs for their own use from the home page of Consignee on the basis of this contract for a fee. 
These terms and conditions shall be considered as concluded by and between the Parties by the registration of User and the acceptance of such registration by Consignee in electronic format. In these terms and conditions any declaration made in an e-mail shall be considered as written records by the Parties.
1. RIGHT 
Consignee has taken over photographs from professional photographers having copyright over such photographs and from advanced amateur photographers for an indefinite period of time in the form of electronic uploading in the quality and with the theme accepted by Consignee for the sale of such photographs within the scope of consignatory construction. The taken over photographs have been displayed on the home page of Consignee.
Being aware of these antecedents, User may download the photographs displayed on the home page by electronic format in accordance with these terms and conditions.
2. ESTABLISHMENT OF THE LEGAL RELATIONSHIP 
2.1
By registering on the home page of Consignee User shall accept these terms and conditions and acknowledges them as binding. The application of the possible terms and conditions of User is excluded. For successful registration these terms and conditions must be accepted by the User. Participation in the registration process and the registration itself shall mean the acceptance of these terms and conditions. 
These terms and conditions shall be considered as concluded by and between the Parties upon the registration of User and the acceptance of such registration in electronic format by the Consignee. 
The Parties are entitled to conclude the contract in this manner in accordance with Section 45 (3) of Act LXXVI of 1999 on Copyright.
2.2
By accepting this agreement User declares that the details provided by them in the course of registration are true and correct, and that their personal details may only be used for the purpose of the application of the Contract of Use. 
2.3
In accordance with the provisions of Act LXIII of 1992 on Personal Details, Consignee must handle the personal details became known to him in the course of the registration by taking into consideration the specific purpose.
2.4
Consignee shall inform User on the acceptance of the registration in an e-mail, which notice shall establish a legal relationship between the Parties. In the e-mail sent about the successful registration the user name and password selected by the User shall be confirmed, which user name and password must be used by User in the course of the legal relationship.
User may begin purchasing credit points upon the valid registration. The purchase of such credit points is a precondition for downloading photographs from the home page.
The credit points may be purchased by completing the order form to be found on the home page.
3. The sale of the Photographs 
3.1
The photographs will only be sold by the Consignee via the home page in such a manner that User may only download the photographs upon the purchase of the credit points. The credit value depending on the download size of the individual photographs or the decision of the author shall be displayed next to the photographs in the gallery of the individual authors continuously.
The credit values of the sold photographs according to their size is as follows:

The current value of the individual credit points shall be displayed on the home page by the user continuously.
User shall be entitled to determine and change the value of the credit fees unilaterally. User shall be entitled to exercise such right on 1 July and 1 January each year. 
3.2
Upon the purchase of the credit points by bank transfer User may download the photograph(s) of appropriate size selected by the User up to the limit of the purchased credit points. 
4. RIGHTS AND OBLIGATIONS OF CONSIGNEE 
4.1
Consignee hereby declares and warrants that he has the right of use with regard to the consignatory sale of the photographs protected by copyright which have been placed on the home page.
4.2
Neither User nor any third party shall obtain any other rights in addition to the right of use specified herein over the textual and picture content placed on the home page upon the publication thereof. 
4.3
Consignee excludes liability in such cases when the content published on the home page by User or any third party is not used by others for the intended purpose or it is used in an injurious manner, thus, among others, for damages caused by the use thereof for commercial purpose.
4.4
Consignee refuses to accept liability for technical problems arising from the temporary interruption of the services, even if such interruption of services has not been communicated beforehand. Consignee does their utmost to recover the services as soon as possible. 
4.5 
Consignee maintains the right to modify or supplement these terms and conditions of use at their discretion. Consignee shall inform the users about such modifications on the home page. The modification of the terms and conditions does not affect the rights obtained earlier. 
5. RIGHTS AND OBLIGATIONS OF USER: 
5.1
User shall be entitled to download the pictures displayed on the home page by using their credit points for their own use.
5.2 
After the photo has been downloaded by User, the photo may be used with full right of use with no limitation as to its quantity or the manner of its use. Thus, in particular, the User of the photo may reproduce the photo, display it on another home page, use it in catalogues or calendars, and may perform any other activity with it that is not against the law. 
It is against the law – it violates the copyrights of the Author – if User displays the photo as their own photograph, their own file or as an individual creation, or if the photo is sold in such a manner. 
6. MISCELLANEOUS 
Contracting Parties agree that they shall strive for settling any disputes arising from their legal relationship via negotiation. In the absence of an agreement being reached amicably, the parties shall refer the dispute to the exclusive competence of the Municipal Court of Tata.
In case of matters not regulated by these terms and conditions the provisions of the Civil Code and the other relevant rules of law shall apply.
